Former Minister of Transport Tun Dr Ling Liong Sik



KUALA LUMPUR: Former Minister of Transport Tun Dr Ling Liong Sik had given the green light to sign the sale-and-purchase agreement (SPA) before receiving the Cabinet’s written decision, former Transport Ministry Secretary (Maritime Division) Datuk Zakaria Bahari told the High Court on Thursday, Sept 15.

Port Klang Authority (PKA) general manager OC Phang had asked Ling if she could go ahead and sign the SPA with Kuala Dimensi Sdn Bhd (KDSB) at a post-Cabinet meeting with the Ministry of Transport’s (MoT) top officials on November 6, 2002.

The Cabinet had just agreed to the purchase of land earlier that day for the Port Klang Free Zone (PKFZ) transshipment megahub project but the extract of Cabinet’s minutes had yet to be issued.

Zakaria told the Court that this went against protocol because the Cabinet might change its mind at the next meeting hence actions are normally taken upon the receipt of the Cabinet extraction.

The extraction of the Cabinet minutes was only sent to Phang on Nov 20.

Public prosecutor DatukTun Majid Tun Hamzah  had  shown the court a copy of letter from  Zakaria  dated November 20 2002 where he communicated to Phang the Cabinet’s decision on November 6 during the examination in chief of retired transport ministry deputy secretary-general (planning) Datuk Abdul Rahman Mohd Noor.

Zakaria also admitted that he failed to inform Ling about the breach in protocol because the responsibility fell to the Secretary General of MoT, Datuk Zaharah Shaari and that he was, “tak berani bypass boss.”

The SPA that the MoT allowed to be signed differed from a recommendation by Tun Dr Mahathir Mohamad, Prime Minister at the time, Zakaria told the court today.

A letter written by Mahathir had given the go ahead to the MoT to purchase the 1,000 acres of land from KDSB but on the condition that the price has to be renegotiated.

“Does the valuation used in the SPA differ completely from what was instructed by the Prime Minister?” asked Tun Majid.
“Yes it does,” agreed Zakaria.

Zakaria had previously told the court it was his opinion that the RM25 psf price included interest when referring to a report from Valuation and Property Services Department (JPPH) to the Transport Ministry dated September 29, 2000, P16.

However when Wong directed Zakaria’s attention to a memorandum written by former principal assistant secretary P Chandrasekaran on October 14, 2000, Zakaria told the court that in the memorandum, the price RM25 psf did not include interest.

Wong then asked Zakaria if he had checked with Chandrasekaran upon realizing that the memorandum contradicted his understanding of P16, to which Zakaria replied, “I can’t remember.”

“Is it your responsibility to inform either Abdul Rahman or Secretary General of MoT Datuk Zaharah Shaari?” pressed Wong.
“No,” replied Zakaria.
“Did you inform them?” asked Wong.
“No, I did not,” Zakaria replied.

The hearing will continue on October 3.
